Terms and Conditions
1. Scope of Application
These General Terms and Conditions apply to all courses and seminars offered by Swiss Skin Academy (hereinafter referred to as “Swiss Skin Academy”) to its course participants (hereinafter referred to as “Course Participants”).
Amendments to these General Terms and Conditions will be communicated to Course Participants in writing or by email to the (email) address provided by them. Such amendments shall be deemed accepted unless the Course Participant objects in writing or by email within 10 days.
The Course Participant is obliged to notify Swiss Skin Academy immediately of any changes to their postal or email address. Communications sent to an outdated address shall be deemed legally valid if the change of address has not been communicated.
2. Registration
Registration for a course or seminar must be made in writing using the designated registration form. For written registrations, the form will be sent together with the course information by email or, upon request, by post. The form must be signed by hand and returned either by post or as a scanned copy by email.
The course information forms an integral part of the contract.
By registering, the Course Participant submits a binding and irrevocable offer to enter into a contract. Swiss Skin Academy will confirm the registration by email unless it rejects the participation within five working days (Monday to Friday, excluding federal and Canton of Zurich public holidays). The contract becomes binding on both parties upon confirmation of registration or, in the absence of rejection, after a reasonable period.
3. Financial Provisions
Instalment Payments:
Interest-free instalment payments are available for course fees of CHF 500.– or more and are agreed upon individually.
Payment Methods:
Payments may be made in cash or by bank transfer (QR invoice). Card payments (EC, debit or credit card) are not accepted.
Payment Deadlines:
Payment (or the first instalment) is due within five days of registration.
Participation in the course is only possible once the full amount has been paid.
The course fee includes theoretical course materials, certificate and VAT.
Subsequent name changes or replacement of lost certificates will be charged at CHF 100.–.
Costs Covered by Third Parties:
Clarification of any possible coverage of costs (e.g. by an employer, insurance provider, etc.) is the responsibility of the Course Participant.
4. Cancellation or Postponement by Swiss Skin Academy
If there is an insufficient number of participants, Swiss Skin Academy may postpone, combine or cancel courses. Any changes will be communicated in writing. If a course is postponed by more than two months, the Course Participant may reject the new date in writing within ten days. In this case, the contract will be terminated and any payments already made will be refunded.
Course modules that cannot be rescheduled will be refunded on a pro rata basis.
In the event of closures ordered by the authorities (e.g. due to a pandemic), the contract shall remain in force; cancelled lessons will be rescheduled.
5. Termination by Swiss Skin Academy
Swiss Skin Academy may terminate the contract with immediate effect for good cause, particularly in the event of payment arrears exceeding 30 days. Such termination does not release the Course Participant from the obligation to pay for services already provided or services that have been bindingly booked.
6. Cancellation, Postponement or Course Change by the Course Participant
Cancellation or postponement is possible at any time; however, depending on the timing, contractual penalties may apply:
Up to 4 weeks before the start of the course: 20% of the course fee
Less than 4 weeks before the start of the course: 100% of the course fee
Postponements:
A change to another course is possible for a fee of CHF 150.–.
Cancellations and postponements must be submitted in writing by registered mail. Changes are only valid upon written confirmation by an authorised signatory of Swiss Skin Academy.
7. Obligations of Swiss Skin Academy
Swiss Skin Academy undertakes to provide the content specified in the course information and to provide suitable teaching facilities.
In the event of the short-notice absence of an instructor, replacement dates will be arranged.
The language of instruction, course times and course content are based on the information provided on the website.
The Academy reserves the right to make adjustments to course content due to new techniques or market requirements.
8. Obligations of the Course Participant
Punctual attendance is mandatory.
In the event of illness supported by a medical certificate, missed lessons may be made up (valid for a maximum of 1 year). There is no entitlement to a refund. Professional attire is mandatory during practical training (e.g. white work clothing).
Careful handling of equipment, premises and materials is mandatory.
Course Participants must have their own accident and personal liability insurance.
Swiss Skin Academy accepts no liability for loss, theft or damage.
9. Models
Working on models is an integral part of the training. Models are not organised or provided by Swiss Skin Academy.
10. Photo and Video Recordings
The Course Participant agrees to photographs and video recordings being taken during courses and events and to their publication. These recordings may be used for advertising and promotional purposes. Consent may be withdrawn at any time with effect for the future.
11. Data Protection
Swiss Skin Academy processes personal data exclusively within the scope of the training and in compliance with the applicable data protection laws.
12. Final Provisions
Should any individual provision of these General Terms and Conditions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The German-language version shall prevail.
13. Applicable Law and Place of Jurisdiction
Swiss law shall apply, excluding conflict-of-law rules. The place of jurisdiction and performance shall be Winterthur.
